Terms of Service
Effective date: July 12, 2026
These terms govern your use of mastodonmarketing.com and its subdomains, including our free tools (teardowns, audits, scorecards) and our client account-access portal at access.mastodonmarketing.com (together, the "Services"), operated by Mastodon Marketing ("we," "us"), Pearland, Texas. By using the Services, you agree to these terms. Paid engagements are governed first by their own signed agreement or proposal; these terms fill any gaps.
1. Who may use the Services
You must be at least 18 and able to enter a contract. When you act on behalf of a business — including granting access to that business's advertising accounts — you represent that you're authorized to do so.
2. Free tools
Our free teardowns, audits, and scorecards are provided for informational purposes. They reflect our professional judgment based on the data available at the time, and they may be automated in whole or in part. They aren't a guarantee of results, and you're responsible for decisions you make based on them.
3. The account-access portal
- Grant links are private and intended only for the client we send them to. Don't share or forward them.
- By connecting an advertising account, you authorize Mastodon Marketing to access and manage that account for the services you've engaged us for. You keep ownership of your accounts and can revoke our access at any time — from Google Ads (Admin → Access and security), from your Google account (myaccount.google.com/permissions), or from Meta Business Settings (Partners).
- Our handling of data connected through the portal is described in our Privacy Policy, including our compliance with the Google API Services User Data Policy (Limited Use).
- Don't use the portal to connect accounts you don't own or aren't authorized to manage, and don't attempt to probe, disrupt, or misuse the Services.
4. Client work
Marketing involves platforms, algorithms, and markets we don't control. We bring competent, good-faith work and report honestly on results, but we don't guarantee specific rankings, traffic, lead volume, or revenue. Ad spend paid to Google, Meta, or other platforms is always separate from and in addition to our fees, unless a signed agreement says otherwise.
5. Intellectual property
The Services, including their design, content, and tools, belong to us or our licensors. Deliverables we produce for a paying client belong to that client once the related invoices are paid. You keep ownership of everything you provide to us (your brand, accounts, and content), and you grant us permission to use it as needed to do the work.
6. Disclaimers and limitation of liability
The Services are provided "as is" and "as available," without warranties of any kind, express or implied. To the fullest extent permitted by law, Mastodon Marketing will not be liable for indirect, incidental, special, or consequential damages, or lost profits, arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us for the service giving rise to the claim in the three months before the claim arose (or $100 if you paid nothing).
7. Termination
We may suspend or end access to the Services (including disabling a grant link) if these terms are violated or to protect the Services or our clients. You can stop using the Services at any time; provisions that by their nature should survive (IP, disclaimers, limitation of liability) survive.
8. Governing law
These terms are governed by the laws of the State of Texas, and any dispute will be resolved in the state or federal courts located in Harris County or Brazoria County, Texas.
9. Changes
If we make material changes, we'll update this page and the effective date above. Continued use after changes means you accept them.
